If a party is unable to comply with a Determination Order the RTB would encourage such party to contact the other party and negotiate an alternative settlement arrangement with a view to having them withdraw/suspend enforcement proceedings.
If the contact details of the other party are not available, the RTB may be contacted by email to enforceorder@rtb.ie. The RTB, on receipt of an alternative settlement proposal, will contact the other party or will acquire their permission to disclose their contact details.
The RTB does not become involved in brokering settlement agreements or negotiating between parties to a dispute. In the event that an arrangement is reached, settlement should take place directly between the parties to the dispute themselves and the RTB should be advised in writing of same.
Any proposal for an alternative payment plan should set out the following:
- The date of first and subsequent payments;
- The frequency of payments;
- The amount;
It must be noted that the other party does not need to agree to accept such a proposal and may still opt to proceed with their enforcement action.
Any payments made should be made directly to the other party and not the RTB.
