Telephone Mediation Process

Agreement Reached at Telephone Mediation

If an agreement is reached between you and the other party through telephone mediation all parties have 10 days from the date the agreement was reached to withdraw from the agreement and apply to a Tenancy Tribunal. The 10 day "cooling off" period cannot be extended.

If neither party withdraws from the agreement during the 10 day "cooling off" appeal period the agreement will form the basis for a binding Determination Order.

No Agreement Reached at Telephone Mediation

If no agreement is reached between you and the other party through telephone mediation all parties have 10 days from the date the telephone mediation ceases to apply to a Tenancy Tribunal. The 10 day "cooling off" period cannot be extended.

If neither party applies to a Tenancy Tribunal the case will then be closed.

How to Apply to a Tenancy Tribunal

To apply to a Tenancy Tribunal you must complete the RTB Appeal application form.  You can access this form online Here, or call 0818 30 30 37 to request a copy by post.  The case will be referred to a Tenancy Tribunal for a hearing if accepted by the Board.  If you do request the referral of your dispute to a Tenancy Tribunal, please note that you will be required to attend or arrange to be represented at the Tribunal that would then be established to hear into the matter and, in this context, parties should be aware that the Tribunal has power to direct the payment of costs where it considers it appropriate to do so.
